NetSendo Partner Programme Terms

Version partners-1.0 of 8 November 2026, in force from 8 November 2026.

§ 1. Organiser and definitions

  1. The NetSendo Partner Programme (the "Programme") is run by NETSENDO PSA, ul. Jana III Sobieskiego 11 lok. E6, 40-082 Katowice, Poland, entered in the National Court Register (KRS) under 0001216341, NIP 6343067171, REGON 543888605 (the "Organiser"). Contact for Programme matters: contact@netsendo.com.
  2. Partner: a natural or legal person or organisational unit whose application to the Programme the Organiser has accepted.
  3. Partner Panel: https://netsendo.com/en/partners/dashboard, where the Partner sees their codes, links, statistics, commission and payouts and gives payout details.
  4. Partner Code: 3–20 letters and digits assigned to a Partner and typed in the order form on netsendo.com. Every Partner Code also works as a Partner Link: https://netsendo.com/r/CODE and any netsendo.com address with ?ref=CODE.
  5. Referred Customer: a person who ordered a paid NetSendo subscription on netsendo.com with a Partner Code or after arriving through a Partner Link, as set out in § 4.
  6. Payment: the amount the Organiser received for an invoice of a Referred Customer's subscription, after the discount and without VAT or any other sales tax.

§ 2. Joining

  1. Joining is free. Applications are made with the form at https://netsendo.com/en/partners/apply. By applying, the applicant accepts these Terms.
  2. The Organiser reviews each application individually, usually within 2 business days, and may decline it without giving reasons. A declined application may be repeated after 30 days.
  3. The Organiser confirms acceptance by email; the agreement on taking part in the Programme is then concluded for an indefinite period on these Terms.
  4. A Partner must be an adult (at least 18 years old) with full legal capacity, or an entity represented by such a person. The Partner declares that the information in the application and in the Partner Panel is true and, when acting for a company, that they are authorised to do so.
  5. The Partner acts in their own name and on their own account. Taking part in the Programme creates no employment, partnership, agency or representation; the Partner may not conclude contracts or make statements on the Organiser's behalf.

§ 3. Offers for Referred Customers

  1. Each Partner Code gives the Referred Customer one offer, chosen by the Partner when creating the code:
    1. 50% off the first month: on a monthly subscription the first payment is 50% lower; on a yearly subscription the first yearly payment is lower by half of one monthly price;
    2. 30% off for as long as the subscription runs: every payment of that subscription is 30% lower while it lasts.
  2. Offers are for new customers only: not for a person who has paid for a NetSendo subscription on netsendo.com before, and not for the Partner's own email address. They cannot be combined with other discount codes.
  3. The Terms of Sale of NetSendo govern the subscription. The Partner is not a party to the contract with the Referred Customer and may not make statements or promises on the Organiser's behalf.

§ 4. Attribution

  1. A visit through a Partner Link stores the Partner Code in the visitor's browser for 90 days (cookie ns_ref, holding only the code and an optional campaign tag). A later visit through another Partner's link replaces it.
  2. A Partner Code typed in the order form takes precedence over a stored one.
  3. A Referred Customer is attributed to the Partner permanently when the order is placed. Resuming a sleeping NetSendo Cloud instance keeps the attribution.
  4. The Organiser is not liable for missing attribution caused by browser settings, blocked cookies, another device, or an order placed outside netsendo.com.

§ 5. Commission

  1. For each Payment of a Referred Customer the Partner earns:
    1. 50% of the first Payment of the subscription (for a yearly subscription: 50% of the first yearly Payment),
    2. 30% of every later Payment of that subscription, for as long as the Referred Customer pays and the agreement with the Partner lasts (subject to § 8(4)). The Organiser may agree higher individual rates with a Partner; they are shown in the Partner Panel.
  2. Commission is calculated in US dollars on the Payment without tax. Commission amounts are net amounts. No commission is due on the Partner's own purchases, on orders placed in breach of § 7, or on payments that were not received.
  3. Commission is "pending" for 30 days after the Payment and then becomes "payable", unless a refund occurred before.
  4. If a Payment is refunded in full or in part (including withdrawal, complaint or chargeback), the commission is reduced in proportion. Commission already paid out is deducted from the next payout.

§ 6. Payouts

  1. The Organiser pays out the payable balance once a month, by the 15th day of the month, when it is at least USD 50. A lower balance carries over to the next month.
  2. Payouts are made by bank transfer, PayPal or Wise to the details the Partner gives in the Partner Panel; the Partner is responsible for their accuracy. Payouts are made in USD or, at the request of a Partner with an account in PLN or EUR, in that currency at the average exchange rate of the National Bank of Poland of the last business day before the payout.
  3. The Organiser bears the fees of its own bank or payment provider for sending a payout. Fees on the recipient's side (receiving and intermediary banks, PayPal, Wise) and currency conversion costs on the recipient's side are borne by the Partner.
  4. A Partner acting as a business issues an invoice to the Organiser for each payout; a Partner registered for VAT adds VAT as required by law, and a Partner from another EU country applies the reverse charge. The Organiser may prepare a statement of commission on which the Partner bases the invoice.
  5. For a Partner who is a natural person not acting as a business, the Organiser fulfils the duties of a tax remitter under Polish tax law (in particular it prepares and sends the PIT-11 information). For this purpose the Partner gives, at the Organiser's request, the data required by law (e.g. PESEL or tax identification number, home address); a Partner resident outside Poland gives a certificate of tax residence. Until these are provided the Organiser may withhold the payout.
  6. The Partner settles the taxes on their commission, without prejudice to the Organiser's duties as a tax remitter under law.

§ 7. Promotion rules

  1. The Partner promotes NetSendo honestly and lawfully, in particular:
    1. clearly tells the audience that they earn a commission (e.g. "affiliate link", "#ad") as required by the rules on unfair commercial practices, the guidance of the Polish consumer protection authority (UOKiK) and the law of the audience's country;
    2. gives true information about NetSendo and current prices from netsendo.com;
    3. does not send unsolicited commercial messages (spam) and complies with data protection law.
  2. In particular, it is not allowed to:
    1. bid on search ads for keywords containing "NetSendo" or misspellings of it, or use the NetSendo name in domains or profile names;
    2. pose as the Organiser or suggest being its representative;
    3. publish Partner Codes on coupon, cashback or loyalty sites without the Organiser's consent;
    4. order subscriptions for oneself or related persons to earn commission, generate artificial traffic or manipulate cookies;
    5. promote in unlawful or offensive content or content that infringes third-party rights.
  3. The Partner may use the NetSendo name and logo only in the form provided in the Partner Panel and only to promote NetSendo within the Programme. This right ends when the agreement ends.
  4. The Partner is responsible for the content they publish and indemnifies the Organiser against third-party claims arising from the Partner's breach of law or of these Terms.

§ 8. Breaches, suspension and termination

  1. If these Terms are breached, the Organiser may suspend the Partner's account (codes stop giving discounts, commission is not approved) until clarified and, for a material breach, terminate the agreement with immediate effect. Commission obtained through a breach is not due; commission already paid is returned or set off.
  2. Either party may terminate the agreement with 30 days' notice by email to the other party.
  3. After termination the Organiser pays out the commission due under § 6, also below USD 50, but not earlier than 30 days after the last Payment that earned commission.
  4. After termination, commission is due on Payments received until the termination date. If the Organiser terminated without a breach by the Partner (including when the Programme ends), commission is also due on Payments of Referred Customers acquired before that date that are received within 12 months after termination.

§ 9. Personal data

  1. The Organiser (contact details in § 1) is the controller of the personal data of applicants and Partners.
  2. We process the application data (name or company name, email, country, channel addresses, information on the audience and the way of promotion, tax identification number), payout and accounting data, the history of codes, clicks, commission and payouts, and a hash of the IP address of the application, in order to:
    1. review the application and perform the agreement on taking part in the Programme (Art. 6(1)(b) GDPR),
    2. settle commission and meet accounting and tax duties (Art. 6(1)(c) GDPR),
    3. prevent abuse and pursue or defend claims (Art. 6(1)(f) GDPR).
  3. Data of declined applications are deleted 12 months after the decision. Partner data are kept for the duration of the agreement and afterwards for the limitation period of claims; accounting documents for the period required by tax law (5 years from the end of the tax year).
  4. Payout details are stored encrypted and accessible only to the people who make payouts. Recipients of data may be our service providers (hosting and database, email, banks and payment providers when making payouts) and authorities entitled by law.
  5. The Partner has the right to access, rectify and erase the data, to restrict processing, to data portability, to object to processing based on legitimate interests, and to lodge a complaint with the President of the Polish Personal Data Protection Office (UODO). Providing the data is voluntary but necessary to take part in the Programme and receive payouts.
  6. Clicks on Partner Links are recorded without an IP address and without a personal identifier (date, code, campaign tag, landing page, referring domain, country and a daily hash used to count unique visits on that day) and are deleted after 400 days.
  7. The Partner receives no personal data of Referred Customers; the Partner Panel shows only the plan, date, subscription status and amounts. Other rules are in the netsendo.com Privacy Policy.

§ 10. Final provisions

  1. The Organiser may change these Terms for important reasons (changes in law, in the NetSendo offer, security, prevention of abuse) by emailing Partners at least 14 days before the change takes effect. A Partner who does not accept it may terminate the agreement with effect on that date.
  2. A change of commission rates applies to Payments received after it takes effect.
  3. The Organiser's liability to the Partner under the agreement is limited to the commission due to the Partner for the last 12 months, except for damage caused intentionally and cases where such a limitation is not permitted by law.
  4. Polish law applies. Disputes are settled by the court competent for the Organiser's registered office, subject to mandatory rules protecting consumers and sole traders treated as consumers.
  5. These Terms are available at https://netsendo.com/en/legal/partner-terms. The Polish version is binding; other language versions are for information.
